California sets the basic pool barrier specifications and your building department inspects against them. We build from the pool permit plans or from an inspector's correction list.

With swimming weather from spring into fall, pools are common behind San Jose homes, and every one needs a barrier that works. California's Swimming Pool Safety Act applies when a permit is issued to build or remodel a pool or spa at a single-family home. Health and Safety Code section 115922 then requires two or more of seven listed safety features. An enclosure that isolates the pool from the house is one of the seven.

Section 115923 spells out the enclosure. Minimum height is 60 inches. The gap underneath is 2 inches at most. No opening may let a 4-inch sphere through, and the outside face must have nothing a child under five could use to climb. Gates swing away from the pool, close and latch by themselves, and carry the latch release at least 60 inches off the ground.

Aluminum picket is what we install most, because the pool stays visible from the kitchen window. Vinyl or wood is used when the owner wants privacy. The building department inspects the finished barrier and can add local conditions, so we work from the pool permit plans or the inspector's list.

Do I have to fence the pool, or are there other options?

The law lists seven features, among them an isolating enclosure, removable mesh fencing, a safety cover and alarms, and it requires at least two for a pool built or remodeled under permit. The building department and your pool contractor decide which two. We build the fencing.

Can my boundary fence be the pool barrier?

Only when it meets every point in section 115923. Even then it does not stand between the house and the water, so the inspector decides how it counts. We measure your fence against the list during the visit.

Why did my gate fail the pool inspection?

The usual reasons are a gate that does not close and latch by itself, a latch below 60 inches, or a gate that opens toward the pool. All three can be corrected with new hardware or by re-hanging the gate.
