Is a permit required for a fence in San Jose?

Not for most back yard fences. The city requires a building permit only when a fence exceeds the maximum heights in the Municipal Code. The height limits themselves apply to all fences and are lower in front setbacks. We confirm them for your address with the Planning Division of PBCE.
